Van Helsing Arrested for Getting Robbed by Illegal Aliens

Given that our legal system has been completely deranged by moonbattery, see if you can guess how it responded to this case from Wheat Ridge, Colorado:

82-year-old Robert Wallace said in February that he looked out his window and saw two men hooking his flatbed trailer up to their pickup. He yelled at them to stop, but they sped away, stealing his trailer. He told police he fired two shots at the pickup.

Minutes later, police say 32-year-old Damacio Torres dropped 28-year-old Alvaro Cardona off at a hospital emergency room with a gunshot wound to the face.

Torres did not stay to talk with police, but they caught up with him later. According to court documents, he admitted he and Cardona stole the trailer.

Wallace did not want to talk on camera, but when we asked him if the two men threatened him he said, "They almost ran me over."

Now the crooks — both illegal aliens with arrest records, one of whom was under investigation for taking part in a major auto theft ring — are safely behind bars on their way to getting deported, right? Of course not:
The Jefferson County DA's office said that neither Torres nor Cardona have been charged with anything at this point, even though Torres confessed to the crime. However, the homeowner, Wallace is facing twelve felony counts, including four counts of attempted first degree murder. If convicted, he could spend the rest of his life behind bars.

Since they believe in a criminal ideology of theft and coercion (aka "spreading the wealth around"), the liberals who run our courts and our government are criminals. It's hardly surprising that they look out for their own at the expense of their enemy, the respectable citizen.

    The laws are tilted leftward for some reason and have been for along time.Most states say that in order to defend yourself with deadly force you have to try to get away even if they have a gun, you must try to get away first, yes shot in the back before you can shoot to defend yourself and saddly it is in southern states too.

    I knew a man that was awakened out of his sleep got up to see what it was and somebody had broke into his truck and was backing out of his driveway, steeling his truck, he shot through the window killing the guy and was sent to prison for defending his property.

    And yes, Colorado is not a Castle Law state.
    So no, you probably do not have the right to defend yourself or your property with out risking prosecution.
    Sad to say about a western state, but Colorado has a heavy democrat power base.

    And point of fact, no person should expect to get away with theft of property with out the owner protecting it any means they have.
    And for an 82 year old man?
    Damn right he has the right to shoot the scavengers dead. Is he supposed to let them pick him clean?

    Denver and Boulder have high Democrat concentrations, but CO as a whole is more conservative. We're close to a 50/50 state and swing in presidential elections.

    Also, while we may not be a full Castle Law state, we still have Make My Day and it's even been expanded to cover your business -still working on car...

    I am going to refrain from any commentary at this point. The news accounts are often inaccurate on this sort of thing until the facts are fully out. Sometimes the criminals are not charged for weeks until all investigations are thoroughly finished. It just sounds to me that there's more to the story than what is being reported.

    I got locked up for 3 months for battery in a redneck hyper Repub town for defending my home, on my porch against racist pigs who came after me. I was locked up because "I didnt make enough effort to call the authorities before confronting the assailants". Its not a Liberal thing , it a police state thing WHICH IS PURE Rs THESE DAYS.     Being a "redneck hyper Repub" myself, I know that there are two sides to every story and you have conveniently omitted what you did to instigate them.

    I also know that we "redneck hyper Repubs" don't "go after" anyone without proper justification... we don't really care what others do, as long as it doesn't affect our families, homes, friends, communities or property.

    Assuming that he provoked them is indeed the height of folly. Like it or not (not, for most of us) on our side, ideologically speaking, there are those who still keep the flames of racism alive and well. This would also account for the unjust time spent in jail. The story does make sense.

    I don't know if it's true, it's awful convenient if it is, but to say that it's impossible, or to immediately try to shift the blame onto him, is a rather defensive position in the first place.

    Finally, even if he provoked them. (If) for whatever reason, short of shooting, rape, etc... they didn't have the right to "come after him"-- especially on his own property. (assuming we are hearing the truth. I too would hear more of this before judgment is made)

    I am not a liar. My story is not bunk. I didnt accuse anyone here of being a liar or racist like those who I beat down. I was simply trying to say that Police Statism isnt liberal, and its rightwing more often than not. Look at the patriot act, and think of how it can be abused while still following the letter of the law. Look up the laws in your area. Defending your home only goes so far, which doesnt include shooting someone in the face. In my case "defending myself" didnt include breaking bones of the assailants, at least until after I called the cops. I didnt know that till I was in custody. But whatever. Next time Ill make a call then go off. Yes I am a brown person, and being called spic and beaner is the best thing in the world. Especially from strangers. And by the way look up fascist in the dictionary. Its closer to Neocon type ideology than a flaming liberal type.

    Well, what do you know? Your version of 'fascism' was coloured by your own biases. Imagine my surprise. You see, in your zeal to continue your anti-conservative rant, you've blinded yourself to the fact that the heart of fascism isn't about right v. left - though libbies often try to make it about that - it's really about authority v freedom; it describes a style, process and method of totalitarian governance.

    And you know what? Most people who're personally affected by fascism don't really care whether it's right-wing fascism or left-wing fascism that's oppressing them. That's a distinction which rarely makes a whit of difference to them. Being oppressed, imprisoned and bullied by a right-wing fascist is not quantitatively or qualitatively different than being oppressed, imprisoned and bullied by a left-wing fascist, is it now?

    If you were really knowledgeable about the analysis of political ideologies, I suspect that you'd recognise that a)there are more dimensions to the analysis than just right v left, (though you libbie types are so fond of reducing all arguments to just that) and b)that ultimately, at the extremes, there is little functional/practical difference between right-wing totalitarianism and left-wing totalitarianism. The continuum of political ideologies is really more of circle than a straight line with two ending points. Beyond a certain level of government control, the construct of right and left loses all meaning, because the major feature of that government is power and authority relative to the individual citizen, and not political leaning.

    Now run along and go play with the rest of the disaffected youths in your town and leave the adults alone to carry on our discussion.

  • The police aren't to blame here, you arrest someone if they shoot someone, that's the law. Cops just did their job. However, not pressing charges against the criminals and doing so against the guy defending himself was done by the state not the cops.

    That's how it works, cops don't build cases, they gather evidence and catch bad guys. Prosecutors and attorneys handle the cases.

    If your story was true you'd probably know that.

    Hard to defend cops these days. This story is getting to be kind of typical as far as police behavior goes.
    I have seen cops let assailants walk on a few occasions after assaulting someone.
    They could argue that they knew where to find the person...
    But when that person is a risk to the public, and the job of a cop is supposed to protect the public?
    Lately it seems all they are interested in is generating revenue for their own paychecks.
    And I am speaking in general terms, I still know a few good law enforcement officers.

  • I don't know the laws in CO well enough to know whether Mr. Wallace violated them. But I do understand common sense pretty well, and his prosecution and the simultaneous lack of prosecution of the thieves sends out a pretty clear message to people. Don't defend your home or your life.

    If Mr. Wallace did indeed overreact and in so doing, legitimately violated the law, then so be it. But this has all the earmarks of an overzealous prosecutor who throws the book at a defendant in order to pressure him into pleading to a lesser crime. I suspect that he's not prosecuting the thieves in return for their testimony against the homeowner.

    I hope the voters of the county oust him from his position at the next opportunity since he's not working for the people who pay his salary to enforce the laws with equanimity.

    Not sure whether this would apply as Mr. Wallace was outside his home, but as the crime was committed on his property and he was defending his property, I think a case could be made in his favor and possibly even a challenge of the statute to include defense of property on property, but not within the house.

    TITLE 18 CRIMINAL CODE : ARTICLE 1 PROVISIONS APPLICABLE TO OFFENSES GENERALLY

    18-1-704.5 Use of deadly physical force against an intruder.
    Statute text

    (1) The general assembly hereby recognizes that the citizens of Colorado have a right to expect absolute safety within their own homes.

    (2) Notwithstanding the provisions of section 18-1-704, any occupant of a dwelling is justified in using any degree of physical force, including deadly physical force, against another person when that other person has made an unlawful entry into the dwelling, and when the occupant has a reasonable belief that such other person has committed a crime in the dwelling in addition to the uninvited entry, or is committing or intends to commit a crime against a person or property in addition to the uninvited entry, and when the occupant reasonably believes that such other person might use any physical force, no matter how slight, against any occupant.

  • I really am thankful for Texas' castle doctrine. The right to use deadly force for the protection of property. If this man lived in Texas he would be immune to prosecution, and civil liability.

    Thanks to our idiot Governor the illegals still wouldn't be in jail though.
