Minute 16 Of Her 15 Minutes Of Fame: Shirley Sherrod To File Nuisance Lawsuit Against Andrew Breitbart

Shirley Sherrod, who seems to spend most of her time accusing everyone who doesn’t agree with her of being racist, is going to try to sue Andrew Breitbart,

Ousted USDA employee Shirley Sherrod says she will sue conservative blogger Andrew Breitbart, the Associated Press reports. Sherrod made the announcement Thursday in San Diego at the National Association of Black Journalists annual convention.

What is Shirley Sherrod going to sue Breitbart for? Showing a clip of her speech where she admitted to engaging in a racist act? Give me a break. If you could win lawsuits over something like that, there would be 500 of them being filed per day. It’s a non-starter in a court of law and there’s no point to even suing in this case, since Breitbart can afford a lawyer, other than to try to extend Sherrod’s 15 minutes of fame.

Furthermore, it’s not just me saying that Sherrod can’t win in court. Ron Coleman, an outstanding lawyer who specializes in Internet based law, doesn’t see this case going anywhere.

Here’s what he told me,

The burden for public figures to recover for defamatory reporting — even when it is false — is so high that it is effectively insurmountable. There’s nothing I’ve heard so far about this case that would suggest why that general rule would not apply here.

In other words, this lawsuit, like Shirley Sherrod, is a waste of time.

    Releasing a video and accusing someone of being racist, accusing a woman who's father was murdered by whites, known whites, who were never brought to justice, of being racist, in order to attack the NAACP, is the point.

    In a civilized society not-so-Breitbart's shenanigans are kept in check by the news media and common sense. In this “anything goes” environment fostered by republicans and the tea bagger movement, Not-so-Breitbart's antics are fodder for a complacent media. A woman's reputation was questioned and her livelihood was destroyed in the process.

    Why are you so eager to make everything about Obama? Is it projection, because of the way the last administration manipulated every detail whenever possible, so you just can't accept that the transparency you see is not a cover, but actual transparency?

    What about just accusing them with no evidence? Is that still ok? Because there are a number of democrat politicians who will be in big trouble if calling people racist without evidence becomes punishable. They're safe on the “calling people racist with evidence” front, as that hardly ever occurs.

    Andrew Breitbart did not at any point accuse this woman of being a racist. He's said numerous times that the reason he posted that video was to show the NAACP members clapping and cheering for racist acts. He never wanted her fired, he never called for her to be fired, in fact he never said anything about her at all until after everyone else started calling for her to be fired and after Obama panic-fired her in a desperate attempt to grease the undercarriage of his proverbial bus.

    Sherrod is going to loose, she made the mistake of filing her suite in a San Diego Court. All Breitbart has to do is file a Special Motion to dismiss under the Californ Code of Civil Procedure section 425.16. Commonly refered to as the anti-SLAPP (Strategic Litigation against Public Participation) law.

    The beauty of this is that it is going to force Sherrod to prove in court, without discovery, that she can prove her case. All Breitbart has to do is prove that he was engaging in a constitutionally protected activity.

    In my not so humble oppinon it proves to me that Sherrod, besides being a racist, she is is also stupid, to have hired a lawyer who isn't familiar with California Civil Code.

    California may be La La Leftist Land to the rest of the nation but there are laws on the books stringently protect freedom of speech and freedom of the press.
