Could Obamacare Architect Be Prosecuted For His Deceit?

Deceit. Fraud. Premeditated felonious theft from millions of Americans.

Now that Jonathan Gruber, known as “The Architect” of Obamacare, has been publicly revealed as a joyful con artist in a YouTube video, are his actions prosecutable?

The victims are the millions of Americans who lost their major medical insurance policies due to Obamacare, lost their doctors, their children’s doctors, their family’s cancer specialists and coverage at children’s hospitals and cancer clinics because of a law that was sold to Americans as being just the opposite.

The victims are the millions of Americans whose premiums increased so dramatically that they are forced to drop their coverage.

A video recently posted of the MIT professor speaking in 2013 as an academic panelist is a criminal confession in which he gleefully bragged that the ironically-named “Affordable Care Act” was written in such a way as to obfuscate the true nature of the bill’s effects and hide from the American public and the Congressional Budget Office the fact that if they told the truth the bill would not pass.

In Gruber’s own words: “This bill was written in a tortured way to make sure CBO did not score the mandate as taxes. If CBO scored the mandate as taxes, the bill dies. Okay, so it’s written to do that.  In terms of risk rated subsidies, if you had a law which said that healthy people are going to pay in – you made explicit healthy people pay in and sick people get money, it would not have passed… Lack of transparency is a huge political advantage. And basically, call it the stupidity of the American voter or whatever, but basically that was really, really critical for the thing to pass… Look, I wish Mark was right that we could make it all transparent, but I’d rather have this law than not.”

Liberal elites nod their heads at this, agreeing that the American people are too stupid to know what’s good for them. The elites feel compelled to tell you and me how we should live. After all, it “was really, really critical for the thing to pass.”

I called constitutional attorney John Whitehead, the successful civil liberties lawyer who has avenged many poor citizens horribly abused by enforcers of rabidly aggressive laws.

My goal was to learn if Herr Gruber could be not only prosecuted but successfully prosecuted.

Mr. Whitehead’s Rutherford Institute successfully represented the woman handcuffed and arrested by police in Florida for the crime of allowing her 9 year-old son to play in the nearby playground while she worked and kept tabs on him via cellphone.

He caused a school district to cease their practice of having students complete mental health and suicide surveys without their parents’ written consent.

In an amicus brief, Rutherford Institute attorneys argued that defining the parameters in which corporate entities may operate is a matter to be settled by the States and those who govern those entities, noting that “states both enable and require corporations to make moral decisions and to engage in practices that result from those decisions.”  This led to the Supreme Court win for the religious liberty rights of business owners, in a 5-4 decision stating closely held corporations have a right to religious expression, in addition to the already established right to political expression.

Mr. Whitehead’s knowledge and experience make his opinions credible.

So I asked, “Is Herr Gruber’s confession of deceiving American people to the tune of millions of dollars and heartbreaking anguish enough for a successful prosecution?”

Mr. Whitehead: “Yes, but who will prosecute? The criminal prosecutor would have to come from the Department of Justice.”

Oh.

This is important also because Gruber articulates exactly what this administration thinks of the American people: you are stupid cretins and they are perfectly wise.

While the 2013 “Lie of the Year” was Obama’s pledge that you can keep your doctor and your health insurance, the 2014 “Weasel of the Year” must surely be Herr Gruber, architect of fraud and deceit.
