BREAKING: Illegal Immigrant Deported 5 Times Who Killed Woman in SF Gets Off With ‘Time Served’

In a breathtaking travesty of justice, illegal alien Jose Ines Garcia Zarate was given three years for weapons possession after he was acquitted of murdering Kate Steinle in San Francisco. That turned into time served because he has been in custody since 2015 when he killed Steinle. He will be on parole for 48 months and will remain in custody to face federal charges. Zarate will be turned over to the U.S. Marshals to face new charges in federal court, under an indictment handed down on Dec. 5th. A federal grand jury has charged Garcia Zarate with being a felon in possession of a firearm and ammunition and being an “illegally present alien” in possession of a firearm and ammunition. He faces up to 10 years on the weapons charges and they want to deport him for a sixth time.

San Francisco Superior Court Judge Samuel Feng denied the request from the defense for a new trial. This guy is a seven-time felon and has been deported five times previously. The gun that killed Steinle was stolen. After killing her, he dumped it in the Bay. None of that mattered to his jury and he was found not-guilty of murder. There will be no justice for Kate Steinle in all this. It makes me physically ill. Zarate was released from jail several weeks before he killed Steinle… that’s what a sanctuary city does for you.

Defense lawyers argued in court papers that the judge improperly barred the jury from considering Garcia Zarate’s claim that he didn’t know he was holding a gun when it fired. They also argued that he didn’t hold the gun long enough to warrant a firearm possession conviction. That is the most ridiculous thing I’ve ever heard. They also said he threw it in the Bay to keep it from firing more after he killed Kate. He must think people are morons and I guess he’s right.

At a hearing Friday, Garcia Zarate entered the courtroom wearing a huge oversized bright orange sweatshirt and sweatpants. He was uncuffed and smiling as he shook the hand of each member of his defense team, including new attorney Tony Serra. Public defender Matt Gonzalez told reporters the new charges are “discriminatory” and a reaction by administration officials upset over his client’s acquittal of murder and assault. Serra blasted the federal government for filing federal charges against Garcia Zarate after he was cleared of most state charges. “Shame on the federal government, shame on the Trump administration. Shame on them in terms of bringing a retaliatory, vindictive prosecution,” Serra said. “So we will take those issues on.”

“A vote for guilty in the federal case is a vote for Trump,” Serra said, adding that Garcia Zarate is “being made a martyr to the racist perspective of Trump.” That argument’s a great way to lose your case. The fact that Garcia Zarate was already convicted by a state jury is “going to be in the front lobe of every [federal] juror, and it’s a challenge for me,” Serra acknowledged. This whole thing is a wicked joke and at some point there will be an even higher price to pay for it. I hope they convict him on everything they can at the very least here.
