The Five Keys To Killing Obamacare

Without question, people who zealously guard their freedoms, love their country, and want a better future for their children lost a big battle on Sunday. Yes, Republicans in the House fought skillfully and won the battle with the public, but the legislative chicanery, bribery, and utter disdain for the will of the people won the day for the Left.

Democrats in extremely red districts proved ready and willing to sacrifice their jobs in November to pass the bill. The Stupak block, which held firm for weeks, joined hands with the pro-abortion crowd to federally fund abortions for the first time in our history. The Democrats in Congress didn’t care about the rules, they didn’t care about the consent of the governed, and they didn’t care about what is good for the country. This is a socialist power grab, pure and simple, and a little bit of what has made this a great country died writhing on the floor of the House last night.

The Democrats are calling this a historic moment. So it is. Of course, the same could be said of the crash of the Hindenburg, the sinking of the Titanic, and the start of the Civil War. This is an unconstitutional bill that will increase taxes, increase premiums, hurt Medicare, explode the deficit, federally fund abortions, lead to rationing, reduce quality of care, and dramatically increase the government’s control over your life.

Moreover, unlike Social Security and Medicare, which were both popular bills that were passed with large bipartisan majorities, this bill is unpopular, passed without Republican support, and most of the “benefits” don’t come into effect until 2014. That gives us an opportunity to do something that rarely happens in American politics: We have a legitimate chance to repeal an entitlement program.

Some people in the heat of the moment are talking about repealing Obamacare like it’s a given that’s bound to happen. It’s not. It’s going to be hard work, the results will be uncertain, and it will take years of political combat against utterly amoral opponents who have no qualms about lying, handing out bribes, or shredding the Constitution to get their way.

Here’s a basic outline of what it will take to get it done:

1) Fight the Democrats on Reconciliation. Republicans are saying that they’re going to do anything and everything in their power to block the further damage Democrats want to do to our country via reconciliation. That’s the right attitude to have. However, at the end of the day, if Joe Biden is willing to disgrace his office to prevent the Republicans from offering legitimate amendments, eventually the Democrats will get something through. But, the more Republicans can block, the more discontent there will be on the Democratic side with the bill and less noxious provisions there will be to repeal.

2) Challenge the bill in court. It’s clearly unconstitutional to force people to buy insurance. If the government can force you to buy insurance as a condition of citizenship, why couldn’t the Congress just as easily write a bill forcing you to buy a car from GM? Numerous states will end up challenging the bill in court on that point. Given that we have four Supreme Court justices who believe in following the law, four who generally vote liberal regardless of the Constitution, and Anthony Kennedy who votes based on what side of the bed he gets up on this morning, it’s impossible to say whether these legal challenges will work, but they’re worth trying. If they succeed, suddenly, the whole health care bill, as written, will become unfeasible. That would give us the opportunity to roll it back.

3) Win the public relations war. So far, we’ve won the public relations battle over this bill, but that doesn’t mean we’re guaranteed to win it forever. It’s entirely possible that Obama and health care reform will get a temporary bump from passing health care reform. That’s not the least bit unusual after a big bill like this passes. Happily, that bump will be destined to fade, but expect Democrats to play the PR for all it’s worth. There will also be a limited number of benefits that will kick in immediately. Expect the Democrats and their allies in the mainstream media to tout them endlessly while shamelessly lying and deflecting blame about the negatives. If we’re going to repeal this bill, the truth has to win out over the lies because if the public is tricked into supporting this bill, it’s simply not going to be repealed.

4) The Republican Party has to win big in the next two elections. Here’s the sad reality: Republicans need to win 10 seats to take back the Senate, 40 seats to take back the House, and we need to defeat Barack Obama in 2012. Some people are taking it for granted that all those things will happen. Some people even think we’ll take the House in a walk in November. Maybe that’ll be the case. But, the Democrats have a big cash advantage, the American people have short memories, and eventually, the economy almost has to improve. So, there are no guarantees. If we do take back the House in 2010, it will be because legions of Americans who care about their country were inspired by a despicable bill to put up yard signs, contribute money, make phone calls, and do the rest of the grunt work it takes to get people elected. Are you going to be one of those people?

5) Repeal, replace, and refuse to fund. To completely repeal this bill, we’re probably going to need to control the House, have 60 votes in the Senate, and hold the presidency. Obviously, that’s a heavy lift — particularly getting to 60 in the Senate. However, in the interim, if we can control Congress, we can start tearing this bill apart, piece-by-piece. We can try to get unpopular parts of the bill, like the tax hikes and the individual mandate, repealed. Congress also controls the purse strings; so we can shut down large parts of the plan by simply refusing to fund it. Moreover, we can suggest popular conservative ideas to replace unpopular parts of the bill and force the Democrats to either continue to go against the will of the people or vote them in. Then, if and when we get the votes and the presidency, we can try to repeal the whole thing. Don’t let anyone tell you that this will be easy. But, don’t let them tell you it’s impossible either.

Last but not least, what John Boehner said on the House floor before the vote Sunday night should ring in the ears of every American,

Shame on each and every one of you who substitutes your will and your desires above those of your fellow countrymen. Around this chamber, looking upon us are the lawgivers from Moses to Gaius, to Blackstone, to Thomas Jefferson. By our action today, we disgrace their values. We break the ties of history. We break our trust with America.

Whatever it takes, we will not let it stand.

    Obamacare can be crippled by a strategy of taking on its unpopular parts one by one.

    After November, we go after – first of all – the personal mandate.

    Without the forcing free men to toil like serfs on behalf of the insurance companies Pelosi was supposedly saving us from, the whole scheme begins to unravel.

    Death panels are vulnerable politically. Go after the so-called “advisory committees” by defunding them, greatly abridging the scope of their purview, and making clear that the “medical experts” that man them are just as legally liable for malpractice (i.e., making deadly decisions) as any other doctor making decisions in an office with their patient sitting in front of them. THAT provision alone would neuter the Death Panels.

    Without forcing free men to die like serfs on behalf of keeping Medicare and Social Security solvent due to Death Panel decisions, the whole scheme begins to unravel.

    Finally, once these two objectives are achieved, challenge the whole idea that free men are mere serfs that have the fruit of their toil taken away from them by the likes of elitist Bill Maher, to be distributed to the lord’s favorites. Class Warfare in Reverse will resonate strongly, especially with people with kids in college, struggling to make ends meet, etc.

    In the meantime, I’ve got my fingers crossed that things get really ugly when the people that voted for the abortion that is Obamacare head on home and meet their constituency. The more news coverage of people standing up and saying “enough” in ways that wipe the smirk off of liberals’ faces [AND the more the beloved Mainstream Media calls them names likes fascists, rednecks, racists, etc.] the more the mood to take concrete action to stop this atrocity will spread virally. See, Liberals are too damned stupid to realize that each smarmy post, each insult, each blatant and obvious lie just adds fuel to the fire.

    The entire bill ought to be summarily dismissed by the Supreme Court. It’s unconstitutional at least three different ways. One, the government can not force you to buy a product. Two, the government can not fine (tax) you for not buying a product…that’s a capitance or head tax which is expressedly forbidden by the Constitution. Three, the government has no authority to mandate or manage health care in the Constitution which is a violation of the 10th Amendment. Bonus, since health care is handled by intrastate companies, the government has no authority to regulate it according to the Commerce Clause.

    Failing that, the country will just go bankrupt and all entitlements will stop after we default and foreign countries choose to no longer keep financing an artificially luxurious lifestyle for Americans. Where’s the “social justice” in asking every citizen of China to lend $1000 each to America so we can have health insurance subsidies for people that don’t work? We’ll just become a big Greece, where entitlement leeches riot in the streets until others agree to subsidize their sloth.

    The gov’t can regulate interstate commerce, Mike. And health insurance is interstate commerce.

    By not getting insurance, you are affecting that commerce. Because you are making insurance higher for everyone else when you go to the hospital with no insurance.

    The one true, only, way to repeal it is to win elections.

    Anything else is sour grapes.

    So why not just force everybody to buy a car from GM? People are losing their jobs at car factories. How about making people buy a house? A lot of people are underwater because housing demand is low.

    You’ve perfectly illustrated why “good intentioned” liberalism always turns into fascism, vega. Mandated outcomes at the expense of personal freedoms. A boot stepping on a human face, forever.

    Your argument is BS by the way, and totally ignorant of both the insurance industry and Constitution. No surprise, since your entire side of the aisle is as well as illustrated by Obamacare.

    I like that you can be penalized for not doing something with your own money that affects your own life. By that logic wouldn’t choosing to buy products from another nation that could be made in the US also affect interstate commerce? What about investing in foreign companies? That money could be spent here, it isn’t, so you are affecting interstate commerce. Oh what about leaving with large sums of cash either to immigrate or go on vacation, that money will no longer be in the states to buy goods here. We ought to hit anyone trying to leave with massive exit-taxes, strip them of everything they have.

    I just love that interstate commerce clause loophole. It seems like such a simple and direct thing, not very long, on the face of it doesn’t seem to confer that much power. But the way it has been re-imagined over the years has essentially given the federal government unlimited (and entirely unintended) powers.

    Actually DUMBASS-Vega under current law, since Health insururers can’t sell across state lines, the FED has NO authority to under the Commerce Clause!!!!! Curently health insurance is only allowed to be sold INTRA-state!!!

You will not die with medical debt, no matter how sick you get to take care of yourself. Sell your home if you have one, lose your job, end up on the streets, just don’t ask me to support you.

    Actually Jack I would agree with you. People can choose not to get insurance. They also then choose not to get coverage (or to get emergency coverage at exorbitant rates). Adults are responsible for their own lives in a free society and as such are responsible for the consequences of their actions.

    The reason people are able to get coverage without buying insurance and then pass the costs on to us is because of the regulations leftists have placed on the health care industry; ie everyone is entitled to treatment whether they feel like paying or not.

    Imagine any other industry where the customer was entitled to get whatever he wanted for free if he decided he didn’t feel like paying for it and to compensate the government set up a program that pays for maybe half of what those free-loaders use. I suspect that would raise costs on those who decided to pay, result in wasteful over-usage by those who aren’t paying and ultimately lead to a financial crises for that industry. Hey! That’s exactly what’s happening with our medical care in this country! Imagine that.

    It’s almost like the free market doesn’t function well when the government decides to put unrealistic regulations on it and half control the industry.

    Now thats ripe right there. You couldnt be anymore twisted. What got us into this mess is out of control litigation, govt intrusion into coverage and insurance, and medicare/ medicaid. These have made doctors malpractice insurance and cost to do business go through the roof, and have limited insurance choises. To make a profit(stay in business) they must raise costs out of no fault of their own. That makes doctor visits cost more and makes my health insurance cost more b/c the visits and proceedures cost more. Now we have doctor visits that should be paid out of pocket that are expensive enough to pay with your catastrophic insurance coverage. Insurance was never meant to cover each and every visit. That is why we are in the mess and democrats are the reason. Your team just doubled down to try and “fix” things with more of what got us here today.
