Sadly, the saga continues [2]with the Cosby sexual assault case. This man was once a beloved American icon but has fallen far from that pedestal in light of the ongoing investigations and trials. Do you think this agreement should hold up under legal scrutiny?

A former District Attorney in Pennsylvania claims he made a verbal agreement in 2005 not to use a civil deposition given by Bill Cosby in any criminal matters, potentially jeopardizing the current sexual assault case against the comedian.

CNN has obtained an email from former District Attorney Bruce Castor detailing the agreement he made with Cosby’s lawyers at the time, in which Cosby was being sued by Temple University employee Andrea Constand.

Cosby settled the lawsuit in 2006, however he is now charged with drugging and sexually assaulting Constand, following his arrest on December 30.

In explaining the agreement he made in the email to successor Risa Vetri Ferman, Castor explained he was attempting to help Constand in the case by removing the prospect of Cosby invoking his 5th Amendment right.

Castor wrote in the email to Ferman: ‘I can see no possibility that Cosby’s deposition could be used in a state criminal case, because I would have to testify as to what happened, and the deposition would be subject to suppression.

‘I cannot believe any state court judge would allow that deposition into evidence. …. Knowing this, unless you can make out a case without that deposition and without anything the deposition led you to, I think Cosby would have an action against the County and maybe even against you personally.’

However the current district attorney, Kevin Steele, said Friday he will challenge the unwritten agreement, saying there are numerous protocols used to grant someone immunity, and that Castor did not follow them.

Cosby lawyer Brian McMonagle wrote in the defense motion that the state agreed Cosby would never be prosecuted with respect to the allegations of sexual assault made by the Temple employee, Andrea Constand.

Cosby settled the civil lawsuit with Constand for an undisclosed sum in 2006 after giving four days of deposition testimony.

Several women, mostly from the worlds of modeling, acting or other entertainment fields, have accused Cosby of drugging and molesting them. Cosby, who played Dr. Cliff Huxtable on The Cosby Show from 1984 to 1992 and has been married for decades, has denied any wrongdoing.

Everyone wishes this wasn’t a story. Everyone just wants Dr. Huxtable back. But that is apparently not to be. Whether Mr. Cosby is guilty or not, his legacy is undeniably tainted. Our pasts have a way of catching up with us. And sexual assault never goes away. Nor should it. We’ll all be watching what happens next.
