ACORN Thrilled at O’Keefe Bust

The full story is at the New York Times, “4 Arrested in Phone Tampering at Landrieu Office.” And Michelle Malkin expresses the surprise on the conservative right, “Ugh: ACORN-Buster Busted at Sen. Landrieu’s Office in Alleged Bugging Plot; Affidavit Link Added“:

The New Orleans Times-Picayune reports that James O’Keefe, half of the ACORN-busting duo that conducted undercover stings across the country last summer, was arrested today in an alleged wiretapping plot at the New Orleans office of Democrat Sen. Mary Landrieu. O’Keefe and three other young men were arrested by the FBI. One of the men is the son of the acting U.S. Attorney for the Western District of Louisiana.

The Times-Picayune has not posted the full FBI affidavit, but the details they have are damning. This is neither a time to joke nor a time to recklessly accuse Democrats/liberals of setting this up — nor a time to whine about media coverage double standards. Deal with what’s on the table ….

    Too early to tell but probably he was trying to bug the senator, or at least listen in to her; he probably had good reason for wanting to as well.

    Correct me if I’m wrong, but haasn’t O’Keefe, repeated pointed out that he doesn’t consider himself a conservative nor an activist, just a journalist?

    I think the big lesson to take away from this is that the ends don’t always justify the means. Too often the left ignores this point and I hate to see somebody who is associated with the right engage in illegal activities, even if he did think that by doing so he could get his hands on juicy, even damning information.

    I agree, its wrong to break the law even to catch a lawbreaker – I’ll give you a pass if you are stopping some kind of monster like a terrorist who wants to nuke Chicago, or something but a probably corrupt senator is another issue.

    Well, as far as I’m concerned, a terrorist has no rights. But yes, a corrupt senator, as loathsome as he or she is, is in a different playing field altogether.

    “ACORN Thrilled at O’Keefe Bust” YOU should be thrilled. Unfortunately you don’t denounce him, you just throw up another organization with questionable practices as defense.

    Some examination reveals that the charges are “tampering with the phone system.” There is no mention of “wire-tapping” in them anywhere. Additionally, although a paper reported a quote by an official who would prefer to remain anonymous that they arrested someone connected to O’Keefe who had a “possible listening device” in a car a few blocks away, that information also does not appear anywhere in the charges.

    If O’Keefe did indeed think he could wire-tap a Senator in broad-daylight while openly phoning it all on his cell phone, then he’s gone off the deep end and deserves to face justice; hoever, there have already been some “facts” made up by the media reporting on this case.

    At this point, there just isn’t enough information for anyone to know for sure.

    I agree with aharris here, let this play out and see what actually occured. If he bugged the office he will face charges, however he is innocent until proven quilty.

    According to the news release Tuesday and an affidavit by FBI Special Agent Steven Rayes, who is based in New Orleans, Basel and Flanagan attempted to gain access to Landrieu’s office Monday while posing as telephone repairmen.

    The two men were “each dressed in blue denim pants, a blue work shirt, a light green fluorescent vest, a tool belt and a construction-style hard hat when they entered the Hale Boggs Federal Building,” the release noted.

    After they entered the building, the two men told a staffer in Landrieu’s office they were telephone repairmen, according to the release and Rayes’ affidavit. They asked for — and were granted — access to the reception desk’s phone system.

    O’Keefe, who had been waiting in the office before the pair arrived, recorded their actions with a cell phone, said the affidavit by Rayes.

    Flanagan and Basel later requested access to a telephone closet, claiming they needed to perform work on the main phone system, the release and affidavit stated.

    According to Rayes’ affidavit, the two men went to a U.S. General Services Administration office on another floor and requested access to the main phone system. A GSA employee then asked for their credentials, and the two men said they left them in their vehicle, the affidavit said.

    All four men have admitted their roles in the operation to federal agents, Rayes’ affidavit said.

    If convicted, the four men would each face a possible maximum penalty of a $250,000 fine and 10 years in prison, according to the news release.

    I wonder, had he been looking in to the going-ons of exxon or some big wig republican senator how long would it take the ACLU and hardcore left to rally to his side? He would be a victim of a fascist crackdown on freedom of course.

    I would say first off, good job on the first expose on ACORN, it needed to be done. And if you broke the law here then you need to be punished. Simple enough.

    My take, given how little hard info we have, is that they were trying to show how easily unauthorized persons could gain access to the Senate phone system. Fortunately for us, and not for them, access is not all that easy.

    It is one thing to show that ACORN is a festering pile of leeches, crackpots and criminals; it is another to try to show the same thing about Congress. Congress hides it better behind tougher security.

    Still, it does seem that they got at least some level of access to the phone system. If they can, I wonder who else has done so over the decades. KGB anyone?

    I’ve been in the jury pool in Orleans Parish. Half of the jury will be wearing ACORN shirts. These boys are in for a world of hurt.

    Why? They’ll be disqualified. ACORN members and supporters have a clear conflict of interest.

    I take it you’ve never been to voir dire in Orleans. You can only disqualify so many, and they system will work against them. It’ll be like trying to seat a fair jury for Hitler in Tel Aviv.
