Man Sues In-N-Out After Finding ‘Two Blue Meth Pills And A Napkin In His Drink’

In-N-Out Burger is an incredibly popular chain that offers simplified menu items with fresh ingredients. However, they are currently under fire for an allegation that a customer received two meth pills in the bottom of his drink.[1]

A man is suing In-N-Out Burger after claiming he found two meth pills in the bottom of his drink.

Fred Maldonado of Carlsbad, California was at the fast-food chain’s Downey location last March when he ordered a burger and beverage at the drive-thru window, according to the lawsuit filed in Los Angeles on Wednesday.

He returned to his motel where he ate and drank half of the beverage and went to sleep, according to NBC[3].

However, the next morning when he poured the rest of the drink out, he allegedly found a napkin and the gelatin capsules at the bottom of the cup, the lawsuit said.

‘Plaintiff did not initially know what the two capsules were, but later testing revealed that they were methamphetamine and that it appeared that they may have been illicitly manufactured,’ the lawsuit said.

Maldonado suffered nausea and severe mental distress after consuming the beverage and is seeking unspecified damages, according to City News Service[4].

Following the March 9, 2014 incident, he went back to the restaurant with the cup and the contents and complained to the store’s manager who apologized and offered him a gift certificate for a free burger.

In-N-Out said the claims were ‘baseless’ and that they will address the issue in court. Maldonado has sued the chain alleging negligence and strict liability.

‘At In-N-Out Burger, we have always served the freshest, highest quality burgers, fries, and drinks and customer safety is one of our highest priorities,’ In-N-Out Burger executive vice president Arnie Wensinger said.

‘We will vigorously defend these baseless claims. Due to the fact that this matter involves ongoing litigation, we will unfortunately not be able to comment any further.’

Toxicology findings from last August submitted by Maldonado’s lawyer found the pills contained meth, according to NBC.

However, a test of the napkin and cup conducted by Utica Toxicology Service tested negative for the drug.

It’s impossible to tell what happened based on just the allegations, but this would not be the first time a company was the victim of a fraud scheme.
