Stephen G. Breyer Explains Why It’s OK For Him To Ignore The Constitution

This sort of warped thought process[1] is exactly what’s wrong with liberal judges:

Justice Stephen G. Breyer says the Supreme Court must promote the political rights of minorities and look beyond the Constitution’s text when necessary to ensure that “no one gets too powerful.”

It’s not the job of the Supreme Court to, “promote the political rights of minorities,” or for that matter, to promote the political rights of majorities, liberals, conservatives, or anyone else. Nor should a member of the Supreme Court ever “look beyond the Constitution’s text.”

Supreme Court justices are umpires, not legislators, and they cause innumerable problems when they ignore the Constitution to try to impose their opinions on the rest of society while falsely calling it Constitutional law.

That’s what is so ironic about Breyer claiming that he wants to make sure that “no one gets too powerful,” when he himself is overstepping the boundaries put in place by the Founding Fathers to make sure that judges don’t get “too powerful.” When a judge substitutes his judgment for that of the people and the Constitution, he’s acting like a tinpot dictator in a black robe, not as a judge should behave.
