Bid for EPA to Regulate Ammunition Shot Down

If all you wanted for Christmas was a little good news for a change, here you go. A favorite tactic of Obama’s EPA is to conspire with radical activists outside the government to be sued into extending its tyranny ever further into our lives. Fortunately, despite the increasing glut of leftist judges, this doesn’t always work:

A federal appeals court denied a lawsuit Tuesday by environmental groups that the EPA must use the Toxic Substances Control Act [to] regulate lead used in shells and cartridges.

“We agree with EPA that it lacks statutory authority to regulate the type of spent bullets and shot identified in the environmental groups’ petition,” Judge David Tatel wrote for the U.S. Court of Appeals for the District of Columbia Circuit.

Environmental groups had sued the agency to do so, saying spent lead ammunition posed an “unreasonable risk of injury” to wildlife and humans who would eat the animals they kill.

As noted in the ruling, there is no way the EPA could regulate spent lead with regulating ammunition, the obvious goal of this maneuver, which is yet another attempt to circumvent the Second Amendment. Again we see that there is no form of tyranny progressives will not attempt to inflict in the name of environmentalism.

Next they will claim that gun smoke causes global warming, imperiling the sacred man-eating polar bears.
