Brad Davis, 34, a former Marine told authorities following his arrest in December, 2013 that he was defending himself in a fight against a man his attorney said had bullied him his entire life, reports The Oklahoman.
In the heat of the moment he pulled Denver St. Clair’s underwear over his head and onto the front of his neck, which caught off his air supply, the newspaper reported. He then knocked his 58-year-old stepfather out, he claimed.
Davis was charged with first-degree murder but he reached a plea agreement Monday and pleaded guilty to manslaughter. The two sides did not decide on sentencing and in July Pottawatomie County District Judge John G. Canavan Jr. will choose on a prison term between the minimum length of 4 years and the 35 years the prosecution recommended.
Davis’ attorney Bob Wyatt was unavailable for comment Tuesday, but he told the newspaper St. Clair had bullied his client his entire life.
But Davis never intended to kill the victim, he said.
“I don’t think it was even foreseeable to him,” Wyatt said. “When he was interviewed that night, he said, ‘Man, I did a horrible thing when I gave him that wedgie.’ …He didn’t even really know the guy died.”
Davis lived in a neighboring trailer to St. Clair and his mother who was in the hospital that night. Authorities said Davis had told a friend that night he was going to hurt his stepfather, who had filed for divorce months earlier, the newspaper reported.
